What Do Courts Look For When Determining Custody?

In New York, judges determine custody and visitation based on the “best interests of the child” standard. This standard includes numerous factors, including:

  • The mental and physical health of each parent
  • The financial stability of each parent
  • Which parent, if any, was the primary caretaker
  • The conditions of the home environment
  • Educational opportunities for the child
  • The presence of abuse, neglect or substance addiction

A Trial Is Not Always Necessary, But I’m Always Prepared

For most couples, I believe that working to obtain a parenting plan without litigation is preferable. Litigation is stressful and emphasizes conflict. With children, you want to build a foundation that will permit you and your child’s other parent to work together in a civil relationship that minimizes conflict and focus on the child. Reaching a negotiated agreement is also less costly, but if we cannot obtain a fair custody plan through negotiations, I am prepared to proceed to trial.
